ThankYouReview SMS / Text Message Disclosure

1. For ThankYouReview Customers — Your Role as the Sender

When you use the Service to send SMS messages, you — not ThankYouReview — are the sender, initiator, and author of those messages under the Telephone Consumer Protection Act ("TCPA"), state "mini-TCPA" statutes, and CTIA carrier guidelines. This is reinforced by Section 6.3(f) of the Terms of Service, which you accepted on signup.

ThankYouReview provides the infrastructure only. Message content is either (a) a default template you affirmatively adopted via Settings → Message Templates → Message Preview or (b) a custom template you composed yourself. The Service performs only deterministic variable substitution into your chosen template. The Service uses no artificial intelligence or generative model to compose, modify, or personalize message content.

As the sender, you are responsible for:

  • Obtaining prior express written consent from each Recipient before using the Service to send them a message. Verbal consent, implied consent, and pre-checked opt-in boxes do not qualify.
  • Displaying the signup-time disclosure in Section 5 (or substantially identical language) at the point of collection.
  • Maintaining records of each Recipient's consent, including the disclosure text shown, timestamp, and IP address where technically feasible. The Service's TCPA attestation log helps you meet this obligation, but you remain the record holder of original consent. See Terms Section 6.3(g) for our right to demand production of your consent records within five (5) business days.
  • Honoring opt-outs immediately. The Service automatically suppresses a Recipient after they reply STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, or REVOKE. You must not override that suppression, re-import the Recipient under a different campaign, or contact them through another channel about the same subject matter.
  • Only messaging Recipients who transacted with your business within a reasonable, recent window. The Service is designed for post-transaction review requests, not cold outreach, not prospect lists, not purchased lists, not scraped phone numbers.
  • Not messaging during quiet hours. The Service enforces Recipient-local-time delivery windows (generally 8:00 AM – 9:00 PM local time, stricter where state law requires). Do not attempt to bypass.
  • Paying any fines, penalties, judgments, settlements, and attorneys' fees that result from your non-compliance (see Terms Section 12, Indemnification).

A single TCPA violation ranges from $500 to $1,500 per message. Mini-TCPA states (Florida FTSA, Oklahoma TCPA, Washington CEMA) can add further statutory damages. Comply carefully.

2. For Recipients — What This Service Is

If you received an SMS message that references ThankYouReview or links to a review-request page we operate, this section is for you.

Who sent the message. The message was sent on behalf of a local business (the "Sender") that you transacted with. The Sender uses the ThankYouReview platform to request a review from customers. The Sender is the party legally responsible for the message content and for obtaining your consent.

Why you received the message. You received the message because the Sender indicated you gave consent to receive SMS from them — typically at checkout, during appointment booking, on a paper or digital signup form, or by providing your number to their point-of-sale system with disclosure of SMS use.

Who to contact. For questions about the message itself, contact the Sender directly (the business named in the message). For questions about the ThankYouReview platform or how your number was processed, contact us at hello@thankyoureview.com.

3. For Recipients — What to Expect

  • Message type: standard text messages (SMS). We do not currently send picture messages (MMS) or MMS-based promotions.
  • Frequency: typically one message per transaction. A Sender may send at most one follow-up if you did not respond to the initial message, subject to cooling-off rules. You will not receive ongoing marketing messages from us.
  • Cost: Message and data rates may apply based on your wireless plan. ThankYouReview and the Sender do not charge you directly.
  • Delivery windows: messages are only sent during local daytime hours (generally 8:00 AM – 9:00 PM in your local time zone).
  • Content: a short, personalized request to leave a review of your recent experience, typically with a link to a review platform (e.g., Google Business Profile) controlled by the Sender.

4. For Recipients — How to Opt Out or Get Help

To stop all messages from the Sender via ThankYouReview, reply with any of the following keywords to the message:

STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, or REVOKE

You will receive a single confirmation message and then no further messages from that Sender through the Service. Your opt-out is processed immediately and permanently — even if you later re-engage with the Sender's business, we will not re-enroll your number without a fresh, documented opt-in.

To receive help, reply:

HELP or INFO

You will receive a brief message identifying the Sender and how to contact them.

To opt back in after a STOP, reply:

START or UNSTOP

(This will only succeed if the Sender has taken steps to verify your renewed consent — it is not a simple reversal.)

Standard carrier message and data rates may apply to STOP and HELP replies.

5. Signup-Time Disclosure Language (for Customers to Display)

This is the canonical disclosure language Customers must display at the point they collect a Recipient's mobile phone number for use with the Service. Use it verbatim or in substantially identical form, adapted only to insert the Customer's business name.

By providing your mobile phone number and checking this box, you agree to receive SMS text messages from [Business Name] sent via ThankYouReview requesting a review of your recent visit.

Consent is not a condition of any purchase. Message frequency varies — typically one message per visit, plus at most one follow-up. Message and data rates may apply.

Reply STOP at any time to unsubscribe, or HELP for help. See [Business Name]'s Privacy Policy and ThankYouReview's SMS Disclosure at https://thankyoureview.com/legal/sms-disclosure for details.

This disclosure must be:

  • Placed immediately adjacent to the phone-number input field and consent checkbox (not buried in general Terms).
  • Presented with an unchecked opt-in checkbox. Pre-checked boxes, bundled agreements, or "by clicking Submit you agree to receive SMS" are not valid under TCPA.
  • Linked to both (i) the Customer's own Privacy Policy and (ii) the ThankYouReview SMS Disclosure hosted by us at the URL above.

Required linking to ThankYouReview's hosted SMS Disclosure. The "SMS Disclosure" link must point to https://thankyoureview.com/legal/sms-disclosure (or the substantially identical current version of this document hosted at a stable URL controlled by ThankYouReview). Customers may not substitute their own generic privacy policy for this link — doing so breaks the TCPA consent chain. Customers who wish to host a substitute SMS disclosure must obtain independent legal counsel's written approval of the substitute and notify ThankYouReview in advance.

The ThankYouReview Service displays this language as a default on Customer-facing signup components, pre-fills the hosted disclosure link, and records the Recipient's positive affirmation. Customers who collect consent outside the Service (e.g., via their own website form, their POS system, or a paper intake card) are solely responsible for displaying the equivalent language, including the hosted disclosure link, and retaining records.

6. For Recipients — Your Data

Please see our Privacy Policy, especially Section 3 (Information We Collect — Recipients) and Section 10 (Your Privacy Rights), for details on how we handle your mobile phone number and message metadata.

Summary: your number and delivery status are stored so we can send the messages the Sender asked us to send, so we can honor STOP requests permanently, and so we can respond to carrier, regulator, or legal inquiries. We do not sell or share your number. We do not use it for any purpose other than delivering the Sender's messages. We do not use your data to train artificial intelligence or machine-learning models.

7. Carrier Summary (A2P 10DLC Registration)

The following plain-English summary is provided for US wireless carriers and aggregators who review brand and campaign registrations submitted through ThankYouReview:

  • Platform operator: ANTI-WEAR LLC, a Wyoming limited liability company, doing business as ThankYouReview.
  • Platform purpose: review-request SMS for small and mid-size local businesses.
  • End-sender of each message: the Customer business registered under the campaign. The Customer's legal name appears in brand registration.
  • Use case type: Mixed — transactional review-request (primary), account notifications (to the Customer, not the Recipient).
  • Message composition: no artificial intelligence or generative model is used in message composition. The platform applies deterministic variable substitution (recipient first name, business name, review link) into a Customer-selected template only.
  • Consent model: explicit opt-in, collected by the Customer at point of transaction using the disclosure in Section 5 above. The platform enforces a consent-attestation checkbox before any Recipient number can be messaged and retains the attestation record.
  • Frequency: generally one message per transaction with at most one follow-up. No ongoing marketing sequences.
  • Opt-out keywords: STOP / STOPALL / UNSUBSCRIBE / CANCEL / END / QUIT / REVOKE processed immediately, permanently suppressed at the platform level, enforced across all Customers.
  • Help: HELP / INFO returns Sender identification and contact details.
  • Opt-in flow reference URL: https://thankyoureview.com/legal/sms-disclosure (canonical signup-time disclosure language).
  • Opt-out flow: automatic via SMS keyword reply, logged in platform.
  • Quiet hours: enforced by platform, 8 AM – 9 PM Recipient local time, stricter where state law requires.
  • Restricted content: the platform prohibits SHAFT (Sex, Hate, Alcohol, Firearms, Tobacco/Cannabis) content; gambling; loans; debt collection; political; and any other carrier-restricted category.
  • Sample message (English): "Hi {first_name}, thanks for visiting {business_name}! Would you mind sharing a quick review? {review_link}. Reply STOP to opt out. Msg&data rates may apply."

8. State-Specific Notices

California (CIPA, CCPA/CPRA, Song-Beverly) — California Recipients have enhanced privacy rights. See Privacy Policy Section 11.

Florida (FTSA) — Florida Recipients may have rights under the Florida Telephone Solicitation Act. If you believe a message violated Florida law, contact the Sender and hello@thankyoureview.com concurrently.

Oklahoma (TCPA-Okla.) — Oklahoma's state TCPA tracks federal law and includes a private right of action.

Washington (CEMA) — Washington's Commercial Electronic Mail Act applies to commercial electronic messages, including SMS sent for commercial purposes, and provides a private right of action for violations. Honor STOP promptly.

Maryland — Maryland has enacted SMS consent requirements effective in 2025 imposing additional disclosure and consent-record obligations for commercial text messages sent to Maryland Recipients. Customers sending to Maryland numbers should confirm they meet Maryland's written-consent standard in addition to federal TCPA requirements.

Connecticut (CTDPA) — Connecticut residents have data-rights protections under the Connecticut Data Privacy Act. See Privacy Policy Section 10 for how to exercise them.

Other states — state-specific laws continue to evolve. Recipients in all US states retain federal TCPA protections regardless of state law.

9. Changes to This Disclosure

We may update this Disclosure from time to time. The "Last Updated" date at the top reflects the most recent change. Material changes — particularly changes to frequency, content, or opt-out mechanisms — will be communicated by email to Customers and, where legally required, to Recipients. Recipients do not need to take any action to continue their current opt-out preferences.

For complaints about a specific message, include the sending business's name, the phone number that received the message, and the approximate date and time. We will investigate and respond within a reasonable period, generally no later than 15 business days.
